Terms of Service

OVERVIEW

Welcome to Solaire Training. Throughout these Terms of Service, the terms “Solaire Training,” “we,” “us,” and “our” refer to Solaire Training.

By accessing our website, registering for a class, purchasing a product or service, participating in training or coaching, downloading digital content, or otherwise using our website or services, you agree to these Terms of Service and any additional policies or agreements applicable to the service you purchase.

If you do not agree to these Terms, please do not use our website or services.


SECTION 1 — ELIGIBILITY

By using our services, you represent that you are at least 18 years old or have the permission of a parent or legal guardian where required.

Certain services, including fitness training or other physical activities, may require additional consent, waivers, health questionnaires, or agreements before participation.

You agree to provide accurate, current, and complete information when registering for classes, purchasing services, participating in programs, or contacting us.


SECTION 2 — SERVICES

Solaire Training may provide services including, but not limited to:

  • CPR, BLS, AED, and First Aid training and certification courses

  • Personal training and fitness coaching

  • Exercise programs and workout plans

  • General nutrition and wellness education

  • Meal plans, recipes, and nutrition-related resources

  • Digital educational materials, guides, and programs

  • Group and workplace training

  • Physical products and merchandise

  • Other health, wellness, fitness, safety, and educational services

Availability of services may change at any time.

We reserve the right to modify, discontinue, reschedule, refuse, or cancel services when reasonably necessary.


SECTION 3 — CPR, BLS, AED & FIRST AID TRAINING

Enrollment in a certification class is not guaranteed until payment has been successfully processed.

Some courses may require completion of an online learning component or other prerequisites before attending an in-person skills session. Students are responsible for completing all required prerequisites by the applicable deadline.

Failure to complete required coursework or prerequisites may result in rescheduling and applicable fees.

Students are responsible for arriving on time and meeting the participation and competency requirements established for their course.

Certification is not guaranteed solely by purchasing or attending a course. Students must successfully satisfy the requirements established by the applicable certification or training organization.

Certification requirements, course materials, testing standards, completion requirements, and credential issuance may be established by third-party training or certification organizations and may be subject to change.


SECTION 4 — CPR CLASS CANCELLATIONS & RESCHEDULING

Due to limited class availability and reserved seating, class purchases are considered final and non-refundable except where otherwise required by law or expressly stated in our Refund Policy.

If you cannot attend your scheduled class, please contact us at least 24 hours before your scheduled class time. Your reservation may be transferred to another available class date at no additional cost.

A $15 rescheduling fee may apply in the following situations:

  • Rescheduling within 24 hours of class

  • Failure to attend a scheduled class (“no-show”)

  • Arriving more than 15 minutes late

  • Failure to complete required online coursework or prerequisites before class

Exceptional circumstances, including serious medical emergencies, may be reviewed on a case-by-case basis.

Solaire Training reserves the right to reschedule or cancel a class due to instructor availability, severe weather, facility issues, insufficient enrollment, emergencies, or other circumstances that reasonably prevent the class from being conducted.

If Solaire Training cancels a class, affected students will be provided with appropriate rescheduling or other options in accordance with our applicable policies.


SECTION 5 — PERSONAL TRAINING & FITNESS SERVICES

Personal training, fitness coaching, exercise programs, and related services involve physical activity and carry inherent risks.

These risks may include, but are not limited to, muscle soreness, strains, sprains, falls, cardiovascular stress, injury, aggravation of an existing condition, and other physical complications.

Before beginning an exercise program, you are responsible for determining whether participation is appropriate for you and for obtaining clearance from a qualified healthcare professional when appropriate.

You agree to inform your trainer or coach of relevant limitations, injuries, restrictions, or changes that may affect your ability to safely participate.

You are responsible for stopping an activity and seeking appropriate medical attention if you experience concerning symptoms during exercise.

Additional informed-consent forms, participation agreements, health questionnaires, or liability waivers may be required before participating in certain fitness services.


SECTION 6 — NUTRITION, WELLNESS & MEAL PLAN DISCLAIMER

Nutrition information, meal plans, recipes, wellness education, and related content provided by Solaire Training are intended for general educational and wellness purposes unless expressly stated otherwise.

Our nutrition and wellness services are not intended to diagnose, treat, cure, or prevent any disease or medical condition and are not a substitute for individualized medical care or advice from a licensed healthcare professional.

Clients are responsible for considering their individual dietary needs, allergies, intolerances, medications, medical conditions, and other circumstances before following nutrition or wellness recommendations.

If you have a medical condition, food allergy, history of disordered eating, are pregnant or nursing, take medication, or otherwise have circumstances that may affect your nutritional needs, you should consult an appropriately qualified healthcare professional before making significant dietary changes.


SECTION 7 — NO GUARANTEE OF RESULTS

Individual results from fitness, nutrition, wellness, educational, or training services vary.

Solaire Training does not guarantee specific results, including but not limited to:

  • Weight loss or weight gain

  • Changes in body composition

  • Muscle growth

  • Strength or endurance improvements

  • Athletic performance

  • Health outcomes

  • Achievement of a particular fitness goal

Results may depend on numerous factors outside our control, including individual effort, consistency, health status, nutrition, sleep, lifestyle, genetics, and adherence to a program.

Testimonials, examples, or results shared on our website or social media represent individual experiences and are not guarantees that another person will achieve the same results.


SECTION 8 — FITNESS & COACHING APPOINTMENTS

Personal training, coaching, consultations, or other individually scheduled services may be subject to separate scheduling, cancellation, late-arrival, and no-show policies disclosed at the time of booking or in a client agreement.

Clients are responsible for reviewing those terms before purchasing or scheduling a service.

Packages, memberships, subscriptions, or prepaid sessions may also be subject to additional terms disclosed at the time of purchase.


SECTION 9 — DIGITAL PRODUCTS

Solaire Training may sell or provide digital products including meal plans, workout programs, educational guides, ebooks, templates, videos, recipes, and other downloadable or online materials.

Unless otherwise stated, purchasing a digital product grants you a limited, non-exclusive, non-transferable license for your personal use only.

You may not reproduce, distribute, resell, share, publish, upload, sublicense, or commercially exploit our digital products without prior written permission.

Because digital products may be delivered immediately, purchases of digital products may be non-refundable where permitted by law and as described in our Refund Policy.


SECTION 10 — PRODUCTS & MERCHANDISE

If physical merchandise or other products are sold through our website, we attempt to describe and display those products as accurately as reasonably possible.

Colors, appearance, packaging, ingredients, specifications, or other characteristics may vary where applicable.

We reserve the right to modify or discontinue products at any time.

Any approved merchandise return, refund, or exchange is subject to our Refund Policy.


SECTION 11 — PAYMENTS, PRICING & BILLING

Prices for products, classes, programs, and services are displayed at the time of purchase and may change without prior notice.

You agree to provide current, complete, and accurate billing and payment information.

Where recurring subscriptions, memberships, or payment plans are offered, any recurring charges, cancellation requirements, and billing terms will be disclosed before purchase.

You are responsible for reviewing the applicable terms before authorizing recurring payments.


SECTION 12 — REFUNDS

Refund eligibility varies depending on the product or service purchased.

CPR and certification class enrollments are subject to the cancellation and rescheduling provisions contained in these Terms and our Refund Policy.

Personal training, coaching, digital products, physical products, memberships, and other services may have separate refund or cancellation conditions disclosed at purchase.

Nothing in these Terms limits any refund, cancellation, or other consumer right that cannot legally be waived.


SECTION 13 — WEBSITE USE

You agree not to misuse our website, products, content, or services.

Prohibited conduct includes, but is not limited to:

  • Violating applicable laws or regulations

  • Attempting unauthorized access to our systems or accounts

  • Introducing malicious code, malware, or other harmful technology

  • Using our website or services for fraudulent purposes

  • Interfering with the operation or security of our website

  • Scraping, copying, or reproducing protected content without authorization

  • Impersonating another person or providing intentionally false information

  • Using our materials in violation of our intellectual-property rights

We reserve the right to restrict or terminate access to our services when these Terms are violated.


SECTION 14 — INTELLECTUAL PROPERTY

Unless otherwise stated, content created and owned by Solaire Training is protected by applicable intellectual-property laws.

This may include:

  • Logos and branding

  • Website copy and graphics

  • Photographs and videos

  • Original educational materials

  • Fitness programs and workout plans

  • Meal plans and recipes to the extent protected by applicable law

  • Guides, ebooks, worksheets, and downloads

  • Training resources

  • Social media content

  • Other original materials

Purchasing a service or product does not transfer ownership of our intellectual property.

Unless expressly authorized, our proprietary materials are provided for personal use and may not be copied, reproduced, distributed, sold, republished, or commercially exploited without written permission.

Materials owned by third-party certification organizations, licensors, or other third parties remain the property of their respective owners and are subject to their applicable terms.


SECTION 15 — THIRD-PARTY SERVICES

Our website and services may rely on or contain links to third-party platforms, payment processors, learning systems, certification organizations, scheduling services, applications, or websites.

Solaire Training does not control and is not responsible for the availability, content, privacy practices, policies, or independent actions of third-party services.

Use of a third-party service may also be subject to that provider's own terms and policies.


SECTION 16 — HEALTH & MEDICAL DISCLAIMER

Information provided through Solaire Training's website, social media, educational content, fitness services, nutrition resources, and wellness materials is not intended to replace medical diagnosis, treatment, or individualized advice from an appropriately licensed healthcare professional.

Do not disregard or delay seeking professional medical advice because of information obtained through Solaire Training.

If you believe you are experiencing a medical emergency, seek appropriate emergency medical assistance.


SECTION 17 — ASSUMPTION OF RISK

Participation in physical activities, including personal training, exercise programs, CPR skills practice, BLS training, First Aid training, and other hands-on activities, may involve inherent risks.

By voluntarily participating, you acknowledge that physical activity carries risks and agree to follow applicable safety instructions.

To the extent permitted by law, you voluntarily assume the ordinary and inherent risks associated with the activities in which you choose to participate.

Certain services may require a separate assumption-of-risk or liability waiver before participation.


SECTION 18 — DISCLAIMER OF WARRANTIES

To the extent permitted by applicable law, our website, content, products, and services are provided on an “as is” and “as available” basis.

We do not warrant that our website will always be uninterrupted, error-free, secure, or available.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.


SECTION 19 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Solaire Training and its owners, instructors, trainers, contractors, employees, affiliates, and partners will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from or related to use of our website, content, products, or services.

Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited.


SECTION 20 — PRIVACY

Personal information collected through our website or services is handled in accordance with our Privacy Policy and applicable law.

Additional information may be collected when necessary to provide particular services. Where applicable, additional notices or consent may be provided.


SECTION 21 — ADDITIONAL AGREEMENTS

Certain Solaire Training services may require participants or customers to accept additional agreements, policies, waivers, informed-consent forms, or program-specific terms.

Those additional agreements form part of the terms applicable to that particular service.

If an additional agreement conflicts with these general Terms regarding a specific service, the service-specific agreement will control to the extent of that conflict, unless prohibited by law.


SECTION 22 — CHANGES TO SERVICES & TERMS

We may update our services and these Terms from time to time.

Changes will become effective when posted on our website unless applicable law requires otherwise.

Your continued use of our website or services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.


SECTION 23 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where appropriate.

The remaining provisions will continue in effect.


SECTION 24 — GOVERNING LAW

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.
